In the Tasini vs. New York Times case, the U.S. Supreme Court ruled that the New York Times and other publishers committed copyright infringement when they resold freelancer-produced newspaper and magazine articles via electronic and archival databases such as LexisNexis, without obtaining permission or making additional payments to the authors. Therefore, it is imperative that our newspapers incorporate using contracts when working with freelancers, especially since many papers are creating a web presence. We recommend that you use these contracts with current freelancers, as well as with future who are not on your staffs. The NNPA strongly encourages you to use the following contracts:
